What Is a QDRO, and Why Does It Matter in a California Divorce?

When a couple divorces in California, retirement accounts and pensions are often considered part of the property to be divided, but dividing them isn't as simple as splitting a bank account. It requires a specific legal document called a QDRO.

What a QDRO is

A Qualified Domestic Relations Order (QDRO) is a court order that instructs a retirement plan administrator on how to divide a retirement account between divorcing spouses. Without one, a plan administrator generally cannot legally split the account, no matter what the divorce settlement says.

Why QDROs get rejected

Each retirement plan has its own specific requirements for how a QDRO must be worded and formatted. A QDRO that doesn't meet those exact requirements can be rejected by the plan administrator, delaying the division of assets, sometimes for months, and requiring the document to be corrected and resubmitted.

Many divorce settlements address how retirement accounts should be divided, but the QDRO itself is a separate document that needs to be prepared and submitted after the divorce is finalized. Skipping or delaying this step can leave one spouse without access to funds they're legally entitled to.
